What exactly is the Land Registry Certificate (Nota Simple)?
The Land Registry Certificate (Nota Simple) is a public document issued by the Property Registry in Spain that provides succinct and official information about the legal status of a property (home, local, garage, land, etc.). In the context of legal procedures in Spain, this document is fundamental to guarantee transparency in any real estate transaction.
Unlike other documents, the Nota Simple is purely informative. Its main objective is to disclose who the current owner of the property is, its physical description and, most importantly, what charges or liens (such as mortgages, foreclosures, or easements) weigh upon it. In 2026, the digitalization of these processes allows any citizen with a legitimate interest to obtain it in a matter of hours.
Important Note:
The Nota Simple should not be confused with the Property Deed. While the deed is the original contract signed before a notary, the Nota Simple is the current "reflection" of that property in the public registration system.
What information does it contain?
Property Identification
Includes the physical description of the property: usable and built surface area, boundaries (who the neighbors are), nature (urban or rustic), and its exact location. It also includes the CRU (Unique Registry Code) or the old IDUFIR, essential for locating the property without errors.
Ownership
Full name of the current owners, their DNI/NIE, and the percentage of participation of each (for example, 50% each spouse). It also indicates the title of acquisition (whether it was by purchase, inheritance, or donation).
Charges and Liens
This is the most critical section. Outstanding mortgages, judicial foreclosures, tax liabilities, or rights of way appear here. If the note says "free of charges," it means there are no registered debts.
Marginal Notes
Secondary but relevant information: changes in street numbering, land segregations, or warnings about urban planning processes affecting the home. It is vital for understanding the full legal context of the property before the Cadastre.

How to request the Land Registry Certificate (Nota Simple) in 2026
Gather the necessary information
For the registrar to be able to locate the property, you need at least one of these pieces of data (ordered from most to least effective):
- CRU or IDUFIR: The unique identifier of the property. It is foolproof.
- Registration Details: Property number, volume (tomo), book (libro), and page (folio). You will see this on your deed.
- Cadastral Reference: You can obtain it in our Cadastre consultation guide.
- Ownership and Address: Owner's name and exact address (street, number, floor).
Access the official portal
Enter the electronic headquarters of the Association of Property Registrars. It is the most economical and official channel. If you have a Digital Certificate or Cl@ve, the process will be much smoother.
Prove Legitimate Interest
The law requires you to explain why you want the certificate. The system will give you several options:
Legal investigation
To know the charges before buying.
Credit or Mortgage
To apply for financing from the bank.
Payment and Receipt
Pay with a credit card. Within a period of between 2 and 24 business hours, you will receive an email with a link to download the Nota Simple in PDF format, electronically signed by the Registrar.
Nota Simple vs. Registry Certification
| Feature | Nota Simple | Certification |
|---|---|---|
| Legal Value | Purely informative. Does not provide public faith. | Public document with registry faith. |
| Main Use | Prior information for purchase, rental, or informal procedures. | Trials, foreclosures, complex inheritances, or before courts. |
| Approx. Cost | ~9 € (incl. VAT online) | ~40 € - 60 € depending on length |
| Delivery Time | Almost immediate (max 24h) | Several business days |
Legitimate Interest: Why isn't it free to access?
Many people wonder why you can't simply "download" the certificate of any neighbor. The Property Registry in Spain is subject to the Data Protection Law (LOPD). The Registrar must qualify the request.
To obtain it, you must declare that your interest is, for example: being a potential buyer, being a creditor of the owner, or acting on behalf of a financial entity. If this interest is not proven, the registrar may refuse to issue the certificate to protect the privacy of the owner.
Advice for foreign buyers:
If you are a foreigner and do not yet have your first NIE, you can request the certificate using your passport, but make sure the "legitimate interest" is well justified as "intent to purchase a property."
Frequently Asked Questions
Does the Land Registry Certificate (Nota Simple) expire?
Officially it has no expiration date, but its practical validity is 3 months. Banks and notaries usually require a certificate that is less than 30 days old to ensure that no last-minute charges have been registered.
What happens if the certificate says the house has an embargo?
It is a red alert signal. Before buying, the seller must cancel that embargo financially and in the registry. Never give deposit money without having consulted our safe purchase guide.
Can I request a certificate for a parking space or storage room?
Yes, provided they are registered as independent registry properties. If the parking is an "inseparable annex" of the dwelling, it will appear on the same certificate as the house.
Is it the same as the Cadastre (Catastro)?
No. The Cadastre is administrative (for paying property tax - IBI), while the Registry is legal (to know who the real owner is). Sometimes the surface areas do not exactly match between the two.
What is IDUFIR?
It is the Unique Registry Property Identifier. It has been progressively replaced by the CRU (Unique Registry Code), but both serve to identify a property unequivocally throughout Spain.
Can I request it if I live abroad?
Absolutely. The Registrars' portal is accessible from anywhere in the world. You only need an international credit card and internet access.
Why does my certificate say "Tax Liability" (Afección Fiscal)?
It is very common. It indicates that the property is pending final tax settlement (such as Transfer Tax - ITP or Inheritance Tax). It does not prevent the sale, but the registrar warns that the Tax Agency has priority for collection for 5 years.
How do I know which Property Registry I should go to?
Each municipality belongs to a registry district. If you do it online, the system detects it automatically based on the address. If it's in person, you can check it in the official search engine at registradores.org.
Can a certificate be requested for a company?
For companies, you must request a certificate from the Mercantile Registry. This guide focuses on the Property Registry (real estate). Consult our company creation guide for more info.
What do I do if there is an error in my certificate?
You must go to the Registry with the original deed to request a correction of errors. Some are simple typos and others require an additional notarial act.
