What exactly is IRPF?
The Personal Income Tax (IRPF) is a personal and direct tax that levies, according to the principles of equality, generality, and progressivity, the income of individuals based on its nature and their personal and family circumstances. In the context of legal procedures in Spain, it is the cornerstone for sustaining public services.
Personal and Direct
It adjusts to the specific conditions of each taxpayer, such as their number of children, disabilities, or age.
Progressive
As income increases, the applied tax percentage (tax rate) also increases.
Worldwide Scope
If you are a tax resident in Spain, you are taxed on all income you obtain, regardless of the country where it was generated.
Which incomes must be declared?
Employment Income
Includes wages, salaries, unemployment benefits, pensions, and any remuneration derived from an employment relationship. It is the main component for most citizens with standard employment contracts.
Investment Income
Interests from bank accounts, dividends from shares, life insurance, and income derived from intellectual or industrial property.
Real Estate Income
Income from the ownership of rustic or urban real estate that is rented out.
See contracts →Economic Activities
Income obtained by self-employed individuals and professionals who develop an activity on their own account.
Capital Gains and Losses
Variations in the value of your assets that manifest with any change in their composition. For example, the sale of a home, shares, or cryptocurrencies. It is vital to consult the land registry certificate before any real estate operation to adjust the tax base.

Scope of Application and Residence
IRPF applies throughout the Spanish territory, although Spain has a decentralized system. There are so-called Regional Treasuries (Haciendas Forales) (Basque Country and Navarre) with their own regulations. In the rest of the Autonomous Communities, the tax has a state portion and a regional portion, where each region can vary the rates and apply its own deductions.
When are you considered a tax resident in Spain? You must meet at least one of these criteria:
- Staying more than 183 days during the calendar year in Spanish territory.
- That the main core or base of your activities or economic interests (directly or indirectly) is located in Spain.
- Residence is presumed when the spouse not legally separated and the minor children habitually reside in Spain.
For foreigners, it is essential to correctly manage their NIE or TIE to determine their tax status from day one.
Exempt Income: What is NOT taxed
Not all incoming money is subject to taxation. Knowing the exemptions can save you thousands of euros.

Public scholarships: Those intended for studying at all levels of the educational system.
Maternity/paternity benefits: Aids received from Social Security are exempt from IRPF.
Sale of main residence (over 65s): If you sell your house and you are over 65 years old, the capital gain is not taxed.
Work performed abroad: Exemption up to €60,100 per year if tax reciprocity requirements are met (Art. 7p LIRPF).
