The Rental Agreement in Spain: Legal Guide 2026

Master all legal aspects, rights, and obligations for landlords and tenants under the Urban Leasing Law and the current Housing Law.

Fundamentals of Renting in Spain

"A well-drafted contract is the best guarantee for peaceful coexistence and a secure investment."

What is a Lease Agreement?

It is the legal agreement where the landlord (owner) transfers the use of a property to the tenant in exchange for a monthly rent. In 2026, these contracts are strictly regulated by the Urban Leasing Law (LAU) and updates from the Law for the Right to Housing.

Identification

It is vital to identify the parties with a valid DNI or NIE to avoid invalidation.

Utilities

Don't forget to manage the change of ownership to avoid debts from the previous tenant.

Tax Data

Rent impacts your Tax Return; there are deductions for main residence rental.

1. The Object of the Contract and the Property

For a contract to be valid and secure, the property must be perfectly described. A postal address is not enough. In 2026, it is imperative to include the Cadastral Reference, which you can verify on the official website of the Land Registry (Catastro).

Additionally, it is recommended to attach an updated Nota Simple so that the tenant is certain that the person signing as the landlord is indeed the owner or has legal powers to lease.

Important: The Inventory

If the property is rented furnished, a photographic inventory is your best defense. Both parties must sign every page of the furniture and appliance annex to avoid disputes over the return of the deposit.

2. Duration and Mandatory Extensions

Current regulations in 2026 protect home stability. If you are an individual (individual owner), the contract will be automatically renewed until it reaches 5 years. If you are a company or entity, the term increases to 7 years.

  • Tenant Withdrawal: The tenant can leave after the first 6 months, provided they give at least 30 days' notice. The contract may stipulate compensation of one month's rent for each year remaining to be fulfilled.
  • Recovery due to Need: The owner can interrupt extensions if they need the property for themselves or first-degree relatives, but this must have been expressly stated in the original contract.
  • Tacit Extension: If at the end of the 5 or 7 years neither party communicates their desire not to renew (with 4 months' notice for the owner and 2 months for the tenant), the contract is mandatorily extended for yearly periods up to a maximum of 3 more years.

Economic Conditions and Guarantees

Rent payment is usually agreed within the first 7 days of the month. It is mandatory for the landlord to provide a payment receipt, unless it is done via bank transfer (the most common and recommended method in 2026).

The Security Deposit and Guarantee

The legal deposit (fianza) is always one month's rent for housing. This must be deposited by the landlord in the corresponding organization of their Autonomous Community. Failure to do so carries serious penalties.

Regarding additional guarantees, the law limits them to a maximum of two months' rent in addition to the deposit for long-term contracts, unless the contract is for a duration longer than the legal minimum.

Rent Update

Since 2024 and consolidated in 2026, the update no longer depends strictly on the general CPI in stressed market areas, but on a reference index designed to prevent abusive increases.

Who pays what? Works and Repairs

The number one cause of legal conflicts summarized clearly.

1 The Landlord (Owner)

  • Necessary Repairs: All those indispensable to keep the home in habitable conditions (boiler, roof, main pipes, structure).
  • Improvement Works: After the first 5/7 years, they can carry out improvement works and raise the rent if the legal notification requirements are met.

2 The Tenant

  • Minor Repairs: Wear and tear from ordinary use (changing light bulbs, repairing a faucet, washing machine filter) is the tenant's responsibility.
  • Prohibition of Works: They cannot perform works that modify the configuration of the home without written consent from the owner.

Causes for Contract Termination

Non-payment of Rent

This is the main cause. Non-payment of a single month is enough to start the eviction process. However, in 2026 there are mandatory mediation protocols if the tenant proves a situation of social vulnerability.

Unauthorized Subletting

The tenant cannot sublet rooms or the entire property (for example, on tourist platforms) without express written permission from the landlord. Doing so is an immediate cause for termination.

Nuisance or Unsanitary Activities

If activities that are bothersome to neighbors, harmful, or illegal are carried out in the home, the landlord has the right to request the termination of the contract in court.

Frequently Asked Questions

Can the owner enter the house?

No. The home is inviolable. The landlord needs the tenant's consent or a court order, even to show it to future buyers.

Who pays the IBI and the Community fees?

By default, the owner. However, it can be agreed that the tenant pays them as long as the exact annual amount is stated in the contract.

Can I have pets?

It depends on the contract. If the contract expressly prohibits animals, the tenant must comply. If it says nothing, they are allowed.

When should my deposit be returned?

The landlord has one month from the key handover to check everything and return it. If it takes longer, it accrues legal interest.

What happens if they sell the apartment?

In 2026, the new buyer is obliged to respect your rental contract until the minimum legal term (5 or 7 years) ends.

Is the energy certificate mandatory?

Yes, it is mandatory by law for renting or selling. The tenant has the right to see a copy before signing.
