What exactly is IRPF?

The Personal Income Tax (IRPF) is a personal and direct tax that levies, according to the principles of equality, generality, and progressivity, the income of individuals based on its nature and their personal and family circumstances. In the context of legal procedures in Spain, it is the cornerstone for sustaining public services.

Personal and Direct

It adjusts to the specific conditions of each taxpayer, such as their number of children, disabilities, or age.

Progressive

As income increases, the applied tax percentage (tax rate) also increases.

Worldwide Scope

If you are a tax resident in Spain, you are taxed on all income you obtain, regardless of the country where it was generated.

Which incomes must be declared?

Employment Income

Includes wages, salaries, unemployment benefits, pensions, and any remuneration derived from an employment relationship. It is the main component for most citizens with standard employment contracts.

Office work

Investment Income

Interests from bank accounts, dividends from shares, life insurance, and income derived from intellectual or industrial property.

€€€

Real Estate Income

Economic Activities

Income obtained by self-employed individuals and professionals who develop an activity on their own account.

Capital Gains and Losses

Scope of Application and Residence

IRPF applies throughout the Spanish territory, although Spain has a decentralized system. There are so-called Regional Treasuries (Haciendas Forales) (Basque Country and Navarre) with their own regulations. In the rest of the Autonomous Communities, the tax has a state portion and a regional portion, where each region can vary the rates and apply its own deductions.

When are you considered a tax resident in Spain? You must meet at least one of these criteria:

  • Staying more than 183 days during the calendar year in Spanish territory.
  • That the main core or base of your activities or economic interests (directly or indirectly) is located in Spain.
  • Residence is presumed when the spouse not legally separated and the minor children habitually reside in Spain.

For foreigners, it is essential to correctly manage their NIE or TIE to determine their tax status from day one.

Frequently Asked Questions about IRPF

What is the minimum income to be required to declare in 2026? ▼
In general, those who receive employment income of less than €22,000 per year from a single payer are not required. If there are several payers, the limit drops to €15,000 per year if the sum of the second and subsequent ones exceeds €1,500.
What is joint taxation and when is it advisable? ▼
It is a modality where members of a family unit declare together. It is usually advisable when one of the spouses has no income or very low income, as it allows for an additional reduction in the tax base.
How does selling cryptocurrencies affect IRPF? ▼
They are considered capital gains or losses and are taxed in the savings base. You must declare each exchange or sale made during the fiscal year, applying the corresponding rates (from 19% to 28% depending on the amount).
Can I deduct my home rent? ▼
At the state level, the deduction only exists for contracts prior to 2015. However, almost all Autonomous Communities offer rent deductions in the regional portion for young people or low incomes. Check your rental contract to see if you meet the requirements.
What happens if I submit the return past the deadline? ▼
If you are entitled to a refund, you might receive a minor penalty. If you have to pay, the Tax Agency will apply surcharges for late filing that increase over time, in addition to possible late-payment interest.
What is imputed real estate income? ▼
It is a "fictitious" income that the Tax Agency obliges you to declare for having a second home that is neither your main residence nor rented out. It is calculated by applying a percentage (1.1% or 2%) to the property's cadastral value. Consult the Cadastre to see your value.
