What is Permanent Residency really?

Often confused with nationality, long-term residency (commonly called permanent residency) is the status that authorizes a foreign citizen to reside and work in Spain indefinitely, under the same conditions as Spaniards. In 2026, following recent updates to the Immigration Regulations, this procedure has been simplified for those who demonstrate real integration and continuity in the country.

Indefinite

You do not need to prove economic means or private health insurance to renew the right to reside.

Work Freedom

Allows working both as an employee and as self-employed without additional authorizations from the SEPE.

EU Mobility

If you opt for the "Long-Term EU" variant, you can easily apply for work permits in other Union countries.

To successfully navigate this process, it is vital to differentiate between the General Regime (for non-EU citizens) and the EU Regime. While the first requires strictly fulfilling 5 years of legal residence, the second is designed for relatives of EU citizens who already enjoy a privileged position regarding procedures.

In this guide, we will explore how temporary residency evolves into permanent and which specific documents such as the Foreigner Identity Card (TIE) must be updated.

Fundamental Requirements

It is not enough just to be in Spain; you must meet a series of legal and administrative criteria so that your application is not denied.

01 Continuity of residence
02 Absence of criminal record
03 Previous legal status

The 5-Year Rule

The star requirement is to have resided legally in Spain for 5 continuous years. But be careful: continuous does not mean "without ever leaving". You can leave the country, but absences must not exceed 10 total months within those 5 years, or 6 months in a single period if the reason is not work-related.

How do studies count?

If you came with a study authorization, each year counts as only 6 months (50%) for long-term residency. This is one of the most common errors when calculating time.

Absence of Criminal Records

You must not have a criminal record in Spain or in your previous countries of residence during the last five years for offenses provided for in the Spanish legal system. The administration will verify this automatically in Spain, but you might need to provide certificates from your country of origin duly apostilled.

Required Documentation

  • Application form (Model EX-11)
  • Full copy of valid passport
  • Proof of fee payment (790-052)
  • Census certificate
  • Work history report (optional but recommended)
