What is the Cadastre and why is it the pillar of your wealth security?

The Real Estate Cadastre is an administrative registry under the Ministry of Finance where rural, urban, and special-characteristic properties throughout Spain are described (with the exception of the Basque Country and Navarre, which have their own systems). Unlike the Property Registry, whose function is to guarantee legal ownership and property rights, the Cadastre has a primarily fiscal and statistical census purpose.

Each property in the national territory is assigned a Cadastral Reference, a 20-character alphanumeric code that acts as the "property's ID". Keeping this information updated is not just a recommendation; it is a legal obligation that directly impacts the income tax return, the Property Tax (IBI), and the municipal capital gains tax.

Key Difference: Cadastre vs. Registry

"If the Property Registry says who the owner is, the Cadastre says exactly what the property is: where it is, how many meters it has, and how much it is worth for tax purposes."

What information does the Cadastre contain?

Location and Cartography

The Cadastre offers a precise graphic representation of the plot and the building. It includes GPS coordinates, boundaries, and the exact situation within the urban block or rural plot. This information is vital during the purchase of a home to verify that the walls coincide with physical reality.

Cadastral Value

It is the administrative value set for each property, resulting from the application of the municipality's valuation criteria. It consists of:

  • Land value
  • Construction value
  • Activity costs and profits

Legal Data

Includes the NIF/NIE of the cadastral holder and their percentage of participation in the property. It is fundamental for the correct sending of IBI receipts.

Use and Purpose

Determines if the property is residential, commercial, industrial, agricultural, or for leisure. The change of use (e.g., commercial premises to housing) must be mandatorily reported.

Built Surface Area

Breakdown of square meters per floor and common elements. Includes linked annexes such as garages or storage rooms.

Tax Impact Simulator for Modification

Are you thinking about an expansion or renovation? Calculate how the estimated Cadastral Value could vary and its impact on the annual IBI.

Estimated Result

Cadastral Value Increase 0.00 €
Annual IBI Increase (est.) 0.00 €

* Note: This calculation is a simulation based on average coefficients. The real value depends on the valuation report of each City Council and the age of the building.

How to Modify Cadastral Data

There are three main ways to update your information. The deadline to report changes is two months from the date of the event (deed, completed work, etc.).

1

Declaration (Form 900D)

It is the standard procedure for new constructions, expansions, renovations, or changes of use. It can be submitted online with a Digital Certificate.

2

Rectification of Discrepancies

If you detect an error in surface area or location that has always existed, you must initiate a discrepancy rectification file (Art. 18 Cadastre Law).

3

Notarial Communication

In property transfers, the Notary usually automatically performs the communication of the change of ownership when signing the purchase and sale deeds.

Necessary Documentation for Form 900D

DNI / NIE / NIF: Identification of the holder or legal representative.

Public Deed: Simple copy of the document accrediting the modification.

Dimensioned Plans: If there is a change in surface area, plans before and after the work.

Certificate of Completion of Work: In case of new constructions or full rehabilitations.

Photographs: Images of the facade and renovated rooms (highly recommended).

Cadastral Reference: IBI receipt or descriptive and graphic certificate.

Risks of not updating data

Having an outdated Cadastre is not a saving; it is a latent risk that can materialize at the most inopportune moment.

  • Retroactive Inspections

The Tax Agency can claim unpaid IBI quotas from the last 4 years plus late payment interest if it detects an undeclared larger surface area.

  • Difficulty in Selling or Mortgaging

Banks and appraisers require agreement between the Registry, Cadastre, and reality. If there are discrepancies, the mortgage can be denied.

  • Problems in Inheritances

Valuations for Inheritance Tax are based on the cadastral reference value. An error here can mean paying thousands of euros extra.

Frequently Asked Questions about the Cadastre

What is the Cadastral Reference Value?

It is a value calculated annually from the prices of all property sales performed before a notary. It serves as the minimum tax base for Property Transfer Tax (ITP) and Inheritance and Gift Tax.

Can I modify the Cadastre without a deed?

Yes, for certain physical modifications (such as minor work that changes the surface area) municipal licenses and technical certificates can be provided instead of a public deed.

How long does the Cadastre take to update data?

The maximum legal period to resolve is 6 months, although in practice it can vary between 3 and 12 months depending on the workload of the corresponding Territorial Management.

What is a Cadastral Information Point (PIC)?
