Birth Procedures in Spain: Step-by-Step Guide

The arrival of a child is a unique moment, but it is accompanied by a series of crucial administrative obligations. We explain how to manage the Civil Registry, Social Security, and financial aid efficiently so you can focus on what really matters.

The Importance of Post-Birth Administrative Management

In 2026, the Spanish administration has digitized much of the process for registering new citizens. However, meeting deadlines remains strictly necessary to ensure access to public healthcare, birth and childcare benefits, and recognition of the baby's legal identity.

Whether you are a Spanish citizen or a foreign resident, the steps to follow require precise coordination between the hospital, the Civil Registry, and Social Security. Failure to carry out these procedures on time can lead to the loss of financial aid or delays in pediatric care.

Procedures Roadmap 2026

Eight fundamental steps that every family must follow after delivery.

1. Registration in the Civil Registry

This is the priority procedure. It can be done electronically from the hospital itself within the first 72 hours or in person at the corresponding Civil Registry.

Legal registration documentation

Step 1: Birth Registration

The first legal step is to register the birth. In 2026, most public and private hospitals in Spain offer electronic communication, which avoids traveling.

Electronic Method (Recommended)

  • ✔ Deadline: First 72 hours of the baby's life.
  • ✔ Documentation: Questionnaire provided by the hospital, DNI/NIE of the parents, and medical report of birth.

In-Person Method

If it is not done at the hospital, parents have a period of 10 days (extendable to 30 with justified cause) to go to the Civil Registry of their town. It is essential to bring the Family Book or request a new one if it is the first child.

Note for foreigners: If the baby is born in Spain but neither parent is Spanish, registration is equally mandatory. Depending on nationality, the baby could be entitled to nationality by presumption.

Health and Social Security Management

2 Healthcare Assistance

For the newborn to receive pediatric care, they must be registered as a beneficiary of one of the parents in the Social Security system.

Step A: Online application at the Electronic Headquarters with a Digital Certificate.
Step B: Obtaining the baby's Social Security Number.
Step C: Go to the Health Center with the beneficiary document for the health card.

3 Birth Benefit

Both the biological mother and the biological father (or second parent) are entitled in 2026 to a paid rest period of 16 weeks.

  • 6 weeks: Mandatory and simultaneous immediately after delivery.
  • 10 weeks: Remaining, which can be enjoyed intermittently until the minor turns 12 months old.
  • Amount: 100% of the regulatory base for common contingencies.

Remember that if you are self-employed, you must be up to date with your Self-Employed Registration.

Birth of Children of Foreigners in Spain

If the parents do not have Spanish nationality, the process has important ramifications. A baby born in Spain is not automatically Spanish (except in certain cases), but is entitled to a special residence authorization.

NIE/TIE Application for the minor

Once the birth is registered and the baby's passport from their country of origin is obtained, residence authorization can be requested as the child of a legal resident. Consult the guide for obtaining TIE.

Nationality by Residence

Children born in Spanish territory to foreign parents can apply for Spanish nationality by residence after only one year of continuous legal residence.

Frequently Asked Questions

What happens if the parents are not married?

If there is no marriage, both parents must mandatory attend the in-person registration at the Civil Registry to recognize filiation. At the hospital, they can also do it if both sign the electronic request.

Can I choose the order of the surnames?

Yes, for years in Spain there has been no preference for the father's surname. Parents must agree on the order (Maternal First or Paternal First). This order will apply to all future children of the same couple.

How long do I have to request maternity leave?

Ideally, request it within 15 days following the birth, although you have up to 5 years to claim the right (legal prescription), but economic effects are lost if not requested on time.

Is it mandatory to register the baby in the census (padrón)?

Yes. Census registration (empadronamiento) is the procedure that links the baby with their town hall and allows access to public nurseries, schools, and local health centers.

What is the Full Birth Certificate (Certificado Literal de Nacimiento)?

It is the official document issued by the Civil Registry that proves birth. You will need it to apply for the baby's first DNI or passport.

How do I assign a pediatrician to my child?

Once you have the Social Security registration document as a beneficiary, go to your health center with the census registration and the Family Book. There they will give you the health card and the name of your pediatrician.

What aid is available for large families?

If this is your third child (or second in special cases), you can apply for the Large Family Status (Título de Familia Numerosa), which offers discounts on property tax (IBI), transport, electricity, and university fees.

Can I collect the benefit if I am unemployed?

Yes. Unemployment benefits are suspended and you start receiving birth benefits. Consult the unemployment procedure for more details.
