Legal Deadlines and Consequences

Critical Deadlines

For the change of tax address, the legal deadline is three months from when the variation occurs. However, if you must file your declaration before that deadline, you must update it at the time of submission.

For variations in marital status or births, it is recommended to do so immediately so that it is reflected in payroll tax withholdings.

What happens if I don't file it?

  • Penalties: Fixed monetary fines between €100 and €400 for not communicating census data.
  • Notifications: If the Tax Agency sends a letter to your old address and you do not receive it, it will be considered notified after its official publication, which can cause surprise seizures.
  • Loss of benefits: You will not be able to apply for child deductions if they do not appear in your census.

Frequently Asked Questions

1. Is it mandatory to file form 030 every year?

No. It is only mandatory when there are variations in your personal data, address, or family situation. If your data is the same as the previous year, you don't have to do anything.

2. Can I file it without a digital certificate?

Yes, you can print the PDF form from the AEAT website and deliver it in person or send it by certified administrative mail.

3. I just arrived in Spain, do I need Form 030?

Yes, it is the first step to obtain your NIF if you are not going to be a freelancer. It is essential to be able to work as an employee and for your company to be able to apply the correct IRPF withholdings.

4. Which address counts if I live in two cities?

For the Tax Agency, the tax address is where you reside for more than 183 days a year. Generally, it must match your primary census registration.

5. Can I change my data from the AEAT App?

Yes, the Tax Agency's mobile application allows the modification of the tax address very quickly through the Cl@ve system.

6. Is Form 030 used to register as a freelancer?

No. For economic activities, you must use Form 036 or 037.

7. Does Form 030 influence my income tax return?

Very much so. The data from Form 030 are those that appear by default in your income tax return draft. If they are wrong, you could be losing money on regional deductions.

8. What do I do if I made a mistake filling it out?

Simply file a new form by marking the "Modification" box (102) with the correct data. There is usually no penalty for voluntarily corrected errors.

9. Is the tax address the same as the address for notification purposes?

Normally yes. But Form 030 allows you to provide a different address to receive Tax Agency letters (for example, an office or agency).

10. Do I have to file Form 030 to include a newborn child?

Yes, it is highly recommended. By including them in the census, the Tax Agency system will already be prepared to apply the minimum for descendant in the next tax campaign.
